Senate Bill 310 (Wiener) is expected to reach the Senate floor for a vote next month. Torrance Area Chamber of Commerce Government Affairs Policy group encourages members to take action and oppose this bill, which would create a new private right of action in wage and hour cases. These penalties can already be pursued through the Labor Commissioner or the existing PAGA process.

SB 310 would bypass the PAGA reforms enacted in 2024, which were designed to reduce unnecessary litigation and improve fairness for small employers. Those reforms included early resolution options and reduced penalties for businesses that are making good faith efforts to comply with the law.

Concerns have been raised that SB 310 would remove important safeguards, allow penalties to be used as leverage in lawsuits, and undo the structure that was the result of extensive negotiation last year.
